(Folhapress) – O ministro Cristiano Zanin, do STF (Supremo Tribunal Federal), arquivou nesta sexta-feira (31) um inquérito sobre o ministro do STJ (Superior Tribunal de Justiça) Og Fernandes relacionado à suspeita de venda e vazamento de decisões judiciais.
Zanin atendeu a um pedido da PGR (Procuradoria-Geral da República), que entendeu não existir elementos na investigação que sustentem suspeitas sobre o ministro.
A apuração envolvendo Og foi protocolada em abril deste ano no Supremo e autorizada por Zanin, que colocou o procedimento em alto grau de sigilo. O magistrado do STJ não comenta o caso.
Og foi o terceiro integrante do segundo tribunal mais importante do país sob investigação supervisionada por Zanin. O ministro do STF também autorizou apurações sobre os ministros Moura Ribeiro e Marco Buzzi. Esses outros dois inquéritos continuam abertos.
A solicitação da PGR ocorreu após a Folha procurar o ministro, no início da semana, para pedir uma manifestação a respeito da existência das investigações.
A reportagem apurou que, após o contato, a defesa de Og Fernandes procurou a PGR para solicitar que o órgão apresentasse um parecer sobre o caso e também que houvesse o arquivamento. O procurador-geral da República, Paulo Gonet, se manifestou nesse sentido.
Og, 74, é ministro do STJ desde 2008 e antes disso era desembargador do Tribunal de Justiça de Pernambuco.
Uma das linhas iniciais de apuração da PF investigava suposto vazamento de informações da Operação Faroeste por Rodrigo Falcão, ex-chefe de gabinete do ministro. A Faroeste investiga venda de decisões no Tribunal de Justiça da Bahia e seus principais inquéritos estavam sob a relatoria de Og.
A reprodução de uma suposta decisão sobre o caso foi encontrada em uma conversa no celular do lobista Andreson de Oliveira Gonçalves, mas, após análise, a investigação concluiu que se tratava de um documento falso.
A polícia analisava também o que entendia como discrepâncias nas movimentações financeiras de Falcão.
Em março, no entanto, ao indiciar Andreson e um ex-assessor do tribunal, a PF disse que não havia elementos até aquele momento para que Falcão também fosse indiciado. Procurada por email, a defesa do ex-chefe de gabinete não se manifestou sobre a nova investigação.
Outros ministros investigados
A primeira investigação a vir a público sobre um ministro da corte no caso foi a relacionada a Moura Ribeiro.
A investigação aponta decisões do ministro sob suspeita de terem relação com Andreson e a esposa deste, Mirian Ribeiro, além de transferências a um funcionário que atuou no gabinete dele em 2019 e saiu do tribunal em 2021.
Na ocasião, procurado por meio da assessoria do STJ, Moura Ribeiro disse que desconhecia a existência da investigação.
“O servidor citado pelo jornal atuou como assistente de plenário de 30/01/2019 a 16/06/2019, tendo antes trabalhado em outro gabinete, e foi exonerado da função após atuação irregular, a pedido do próprio ministro”, afirmou.
“Magistrado há mais de quatro décadas, o ministro Moura Ribeiro tem trajetória honrada e enfatiza que são completamente improcedentes quaisquer tentativas de associá-lo a fatos criminosos.”
Outro ministro que a PF investiga é Marco Buzzi, alvo também de um processo disciplinar sob suspeita de importunação sexual e assédio.
Em relatório da Operação Sisamnes, houve menções à advogada Catarina Buzzi, filha do ministro.
No ano passado, a PF sugeriu a necessidade de aprofundar a investigação sobre a relação dela com um empresário suspeito de venda de decisões. Um novo relatório assinado por outro delegado, no entanto, apontou que não havia indícios contra a filha do ministro.
Procurado, o ministro afirma em nota que “não tem relação com atividades de nenhum de seus familiares” e que não tem conhecimento de que seja investigado.
A defesa de Catarina, por sua vez, diz que são descabidas as tentativas de associá-la a irregularidades em decisões judiciais.
