MP do Amazonas investiga descarte irregular de resíduos na Avenida do Samba

Em meio às festividades carnavalescas, que já começaram em Manaus, o Ministério Público do Estado do Amazonas (MPAM), por meio da 63ª Promotoria de Justiça Especializada na Proteção e Defesa da Ordem Urbanística (Prourb), instaurou o Inquérito Civil n° 06.2024.00000670-7 para investigar a permanência irregular de lixo e outros resíduos deixados pelas agremiações na Avenida do Samba. A ação, motivada por possível omissão da Liga Independente das Escolas de Samba do Amazonas (Liesa) e da União das Escolas de Samba do Amazonas (Uesam), tem como objetivo preservar a qualidade de vida e o bem-estar da população.

O inquérito, originado de uma reclamação da Secretaria de Estado de Cultura do Amazonas (SEC-AM), tem base, entre outras leis, na Lei Complementar n° 005 de 2014, que determina que os passeios públicos devem ser livres de qualquer obstáculo, fixo ou móvel, que limite ou impeça o acesso, a liberdade de movimento e a circulação segura das pessoas; e na Lei nº 10.257, de 10 de julho de 2001 (Estatuto da Cidade), que estabelece, em seu art. 2º, inciso I, que a política urbana tem por objetivo ordenar o pleno desenvolvimento das funções sociais da cidade e da propriedade urbana mediante a garantia do direito a cidades sustentáveis, entendido como os direitos, dentre outros, à infraestrutura urbana.

“Instauramos o inquérito para apurar essa irregularidade ambiental, por conta dos dejetos e do lixo, e urbanística, por impedir o direito de ir e vir das pessoas. Além de solicitarmos mais informações dos órgãos envolvidos, vamos acionar a SEC para que compareça e compartilhe mais detalhes sobre o problema”, explicou o promotor de Justiça Paulo Stélio Sabbá Guimarães, autor da medida.

A 63ª Prourb requisitou da Secretaria Municipal de Limpeza Urbana (Semulsp), Liesa e Uesam informações sobre as providências que serão tomadas em relação às denúncias. Caso ainda não tenham sido adotadas medidas, o MP verificará junto à SEC a possibilidade de sanções sustentadas no regulamento dos desfiles carnavalescos.
