O ministro do Supremo Tribunal Federal (STF) Dias Toffoli autorizou, nesta quarta-feira (14), a Procuradoria-Geral da República (PGR) a realizar a extração e a análise de todo o material probatório apreendido na operação Compliance Zero, deflagrada contra o Banco Master e investigados ligados ao grupo financeiro. A decisão revê, na prática, a determinação anterior que previa a lacração e o acautelamento integral do material na sede do STF.
O despacho foi proferido no âmbito da Petição 15.198 e atende a manifestação formal do procurador-geral da República. No documento, a PGR sustenta que a manutenção do material exclusivamente lacrado poderia comprometer o avanço da apuração, ao impedir a análise técnica necessária para a adequada formação da opinião ministerial sobre a materialidade e a autoria dos fatos investigados.
Ao registrar a mudança de entendimento, Toffoli afirma que a reconsideração ocorre “após a exitosa deflagração da fase ostensiva da operação”, destacando que o material colhido deve ser submetido à apreciação do titular da ação penal. No despacho, o ministro ressalta que a providência é necessária para garantir a efetividade da persecução penal.
‘Risco de prejuízo à investigação’
A decisão também registra que a própria autoridade policial solicitou a revisão da medida de lacração. Segundo o despacho, a Polícia Federal apontou o “risco de prejuízo à investigação” caso não fosse autorizada a submissão imediata dos dispositivos apreendidos à análise técnica. A manifestação foi posteriormente endossada pela PGR, que requereu acesso direto ao acervo probatório.
No texto, Toffoli destaca que a análise integral do material permitirá ao Ministério Público obter uma “visão sistêmica” dos fatos apurados. O ministro observa que, em tese, a investigação envolve “crimes de grandes proporções”, relacionados a esquemas de gestão fraudulenta de fundos, desvio de valores e branqueamento de capitais, o que reforçaria a necessidade de exploração imediata dos elementos apreendidos.
Diante dessas ponderações, Toffoli deferiu o pedido da Procuradoria-Geral da República e determinou que fosse oficiado o diretor-geral da Polícia Federal para viabilizar o encaminhamento direto do material à PGR. O despacho prevê que a análise seja realizada sem prejuízo das cautelas necessárias à preservação da prova.
O ministro também estabeleceu orientações específicas quanto à guarda dos dispositivos apreendidos. Determinou que os equipamentos permaneçam eletricamente carregados e desacoplados de redes telefônicas e de Wi-Fi, de forma a assegurar a integridade das informações até a extração e o periciamento pela autoridade competente.
A decisão acrescenta um novo capítulo à sequência de despachos que marcaram a condução da operação Compliance Zero, que inclui a imposição inicial de sigilo rigoroso, críticas posteriores do relator à atuação da Polícia Federal e a revisão gradual de medidas adotadas ao longo do processo. O caso segue tramitando sob sigilo no Supremo Tribunal Federal.
