A Representação Eleitoral foi da promotora Ynna Breves Maia Veloso e a Justiça Eleitoral condenou o candidato a prefeito de Manaus, deputado federal Alberto Barros Cavalcante Neto (coligação PL/ Novo), por propaganda eleitoral antecipada e aplicou-lhe uma multa de R$ 10 mil, atendendo à Representação do MP Eleitoral. No final do mês de abril, apoiadores deputado fixaram um banner gigante (efeito outdoor) na Ponte Rio Negro para divulgar a vinda do ex-presidente Jair Bolsonaro a Manaus, contribuindo para o lançamento da pré-candidatura do parlamentar.
Embora o candidato tenha alegado nos autos que não sabia da fixação do banner e que fora surpreendido pela notícia nas redes sociais, a promotora Ynna Breves Maia Veloso sustentou, em sua representação eleitoral, que Alberto Neto “se beneficiou de propaganda eleitoral antecipada divulgada em local vedado, por meio proscrito e de modo que, as circunstâncias e peculiaridades, tornam impossível ele não ter tido conhecimento da propaganda irregular” em meio e local proibidos pela legislação, tese que foi acolhida pela Justiça Eleitoral. A propaganda, retirada no dia seguinte, também foi afixada nas proximidades da arena Amadeu Teixeira e do estádio Arena da Amazônia.
No entendimento da Justiça Eleitoral, baseado nas provas apresentadas pelo MP Eleitoral, a “magnitude da exposição do cartaz e considerando que a página ‘Direita Amazonas’ (no Instagram) é um dos maiores veículos de divulgação da direita e seus candidatos no Amazonas faz concluir, através das circunstâncias e peculiaridades do caso, pela impossibilidade de o beneficiário não ter tido conhecimento da propaganda irregular”, uma vez que Alberto Neto usou as mesmas imagens, em vídeo, em uma postagem para convidar os próprios seguidores para o evento político, que ocorreu no dia 3 de maio na arena Amadeu Teixeira.
De acordo com o artigo 26 da Resolução TSE nº 23.610/2019, “é vedada a propaganda eleitoral por meio de outdoors, inclusive eletrônicos, sujeitando-se a empresa responsável, os partidos políticos, as federações, as coligações, as candidatas e os candidatos à imediata retirada da propaganda irregular e ao pagamento de multa no valor de R$5.000,00 (cinco mil reais) a R$15.000,00 (quinze mil reais), nos termos do art. 39, § 8º, da Lei nº 9.504/1997”.
Conforme a sentença, disponibilizada na noite de hoje, o candidato ainda pode recorrer da decisão.
