(Folhapress) — O ministro do STF (Supremo Tribunal Federal) Alexandre de Moraes mandou intimar o presidente do Cremesp (Conselho Regional de Medicina do Estado de São Paulo) para que explique as circunstâncias que justificaram a requisição excepcional do acesso a prontuários de pacientes que fizeram aborto legal no Centro de Assistência Integral à Saúde da Mulher, da Unicamp (Universidade Estadual de Campinas). A presidência do órgão é ocupada pelo médico Angelo Vattimo.

O despacho foi publicado nesta terça-feira (3), e deu prazo de cinco dias para que a liderança do órgão seja intimada.
Decisão de Moraes
A decisão ocorre após reportagem da Folha de S. Paulo revelar que o Cremesp pediu o prontuário de todas as mulheres que realizaram aborto legal no hospital nos últimos 12 meses.
A instituição de saúde recebeu um médico fiscal do órgão em 12 de novembro. A estrutura física do local, a abrangência do serviço de aborto legal, dados cadastrais do hospital e alvará foram avaliados.
Em nota, o conselho regional afirmou que a ação fez parte da “Operação Avaliação do Cumprimento do Programa Aborto Legal”, que o conselho afirma ser “uma ação do departamento de fiscalização do Cremesp que, como o próprio nome diz, tem o objetivo de verificar se o Programa Aborto Legal está sendo devidamente cumprido dentro dos ditames éticos da prática médica já estabelecidos”.
O Cremesp disse ainda que a fiscalização foi feita conforme a lei e seguindo as atribuições de conselhos regionais.
O ministro do STF também pediu a intimação dos governos do estado e do município de São Paulo para informarem, também no prazo de cinco dias, se os prontuários foram entregues ao conselho.
“Caso os dados não tenham sido compartilhados, ficam os entes cientificados, desde logo, sobre a proibição de fornecerem dados pessoais constantes de prontuários médicos de pacientes que realizaram aborto legal”, escreveu Moraes.
