Eleições: moradia também é competência constitucional dos municípios

Enquanto cuida da pequena horta de onde tira alimentos para consumo próprio, Elisangela Jesus da Silva, de 45 anos, mantém uma preocupação na cabeça: o medo de ser despejada. Janja, como é conhecida a agricultora urbana, vive há oito anos na Ocupação Aliança em Cristo, organizada pelo Movimento dos Trabalhadores Sem-Teto (MTST), no bairro Jiquiá, zona oeste do Recife. Ela mora com o companheiro – eletricista de automóveis – e dois filhos, de 4 e 5 anos.

A dificuldade financeira é o motivo que fez com que Janja encontrasse na ocupação a resposta para uma necessidade fundamental de qualquer pessoa, a moradia.

“Antigamente eu pagava aluguel, mas ficava muito pesado, porque tinha que pagar aluguel, energia, água, vinha remédio, alimentação… A gente passava por muito aperto, muita dificuldade”, relembra em conversa com a Agência Brasil.

Apesar de as contas da família ficarem menos pressionadas ao viver na ocupação, Janja elege a falta de regularização fundiária como o grande problema atual. “A gente mora aqui, mas não tem legalidade de nada”, diz ela, citando que foram os próprios ocupantes que construíram um sistema de encanamento de água.

A maior dificuldade é a regularização, a gente quer ser regularizado e ficar tranquilo para, futuramente, não sofrer nenhuma ameaça de despejo“, afirma a agricultora.

Ela relata já ter sofrido episódio de expulsão. “Apareceu um dito-cujo proprietário se dizendo dono da área e nos expulsou.”

A prefeitura do Recife informou à Agência Brasil que a regularização fundiária é realizada em áreas classificadas como zonas especiais de Interesse Social (Zeis), e que a ocupação Aliança em Cristo encontra-se fora dessas áreas.

“Além disso, está situada em uma Área de Preservação Ambiental (APA), entre os rios Jiquiá e Tejipió, o que impossibilita a regularização urbana no local”, afirmou.

Questionada se há algum plano de ação direcionado à situação dos moradores do local, a prefeitura não respondeu até a conclusão da reportagem.

Eleições e direito à habitação

O direito à habitação é uma das questões em jogo no próximo dia 6 de outubro, data do primeiro turno das eleições municipais. Mais de 155,9 milhões de eleitores vão às urnas em 5.569 cidades para escolher prefeitos e vereadores.

O direito à moradia reivindicado por Janja é uma garantia de todos os brasileiros, como preza o Artigo 6º da Constituição Federal. O Artigo 23, por sua vez, determina que é competência comum da União, dos estados, do Distrito Federal e dos municípios “promover programas de construção de moradias e a melhoria das condições habitacionais e de saneamento básico”.

Déficit habitacional

Janja faz parte do conjunto de brasileiros que vivencia o déficit habitacional, estimado em 6,2 milhões de domicílios, segundo um levantamento feito em 2022 pela Fundação João Pinheiro (FPJ), instituição de pesquisa e ensino vinculada à Secretaria Estadual de Planejamento e Gestão de Minas Gerais.

O levantamento, feito em parceria com a Secretaria Nacional de Habitação do Ministério das Cidades, considera déficit habitacional situações como necessidade de substituição ou mesmo construção de habitações devido a precariedades de estrutura, gasto excessivo com aluguel e famílias que precisam coabitar imóveis.

O estudo foi feito com dados da Pesquisa Nacional por Amostra de Domicílios Contínua (Pnad), do Instituto Brasileiro de Geografia e Estatística (IBGE), e do Cadastro Único para Programas Sociais (CadÚnico) do governo federal.

A FPJ também estimou que 26,5 milhões de domicílios, cerca de 42% do total existente à época do levantamento, apresentavam ao menos algum tipo de inadequação, seja carência de infraestrutura urbana (energia elétrica, abastecimento de água, esgotamento sanitário e coleta de lixo); pertinente à edificação (ausência de banheiro exclusivo, número de cômodos servindo de dormitório e armazenamento de água, piso e cobertura inadequados) e inadequação fundiária urbana.

Despejos

Além disso, a Campanha Despejo Zero, articulação nacional formada por mais de 175 organizações, entidades, movimentos sociais e coletivos, calcula que haja no país 1,5 milhão de pessoas afetadas por despejo ou remoção forçada.

A organização social Habitat Brasil é uma das instituições que ajudaram no mapeamento de famílias ameaças de despejo, como a da Janja, ou já despejadas. A organização atua no Brasil há 30 anos.

Um dos eixos prioritários de ação é o acesso à moradia digna. Um programa de melhorias beneficiou mais de 2,6 mil casas, e, por meio do programa governamental Minha Casa, Minha Vida Entidades (concessão de financiamento subsidiado a famílias organizadas por meio de entidades privadas sem fins lucrativos), quase 7,6 mil lares foram construídos. As duas frentes de atuação beneficiaram 51 mil pessoas.

Entes municipais

Neste cenário de poucos dias para as eleições municipais, a diretora executiva da Habitat Brasil, Socorro Leite, reforça que o poder municipal tem papel essencial na garantia do direito à habitação.

É responsável por criar leis que regulamentem o uso e a ocupação do solo na cidade. Além disso, é na instância municipal que se definem áreas de interesse que podem ser predominantemente utilizadas para habitação de interesse social”, lista a diretora executiva.

Segundo a ativista, cabe ao poder municipal priorizar áreas de interesse social para produzir novas moradias e garantir o cumprimento da função social da propriedade.

Ela enfatiza ainda o papel de articulador para obtenção de recursos. “É fundamental buscar novas fontes de recursos, não contando apenas com os recursos próprios, que muitas vezes são limitados e disputados com outras áreas igualmente importantes. Buscar financiamento e contrapartidas dos governos estadual e federal é essencial”, diz.

No entanto, Socorro Leite adverte que municípios não podem se submeter a ficar “reféns” apenas dos programas federais de habitação. “Vimos isso na gestão federal anterior, que não destinou recursos para habitação de interesse social, paralisando essa política em muitos municípios”, lembra.

A ativista aponta que a regularização fundiária é uma política que deve ser priorizada. “Não ter a posse da terra regularizada significa estar, de certa forma, sob o risco de despejo”, pontua.

A especialista em urbanismo Paula Menezes Salles de Miranda, professora no Departamento de Arquitetura e Urbanismo da Escola Superior de Desenho Industrial (Esdi) da Universidade do Estado do Rio de Janeiro (Uerj), ressalta o papel dos vereadores na questão habitacional.

“Os vereadores podem criar leis relacionadas à provisão habitacional, saneamento, transporte. Eles também podem destinar recursos, a partir de emendas parlamentares municipais, para projetos específicos, como projetos habitacionais, assessorias técnicas que desenvolvem projetos para população vulnerável, movimentos sociais em luta por moradia”, disse à Agência Brasil.

Plano diretor

Um elemento central para a habitação nas cidades é o plano diretor, lei com diretrizes de como a cidade deve ser ocupada e se expandir. Por ser uma lei, reflete a importância das câmaras de vereadores, que aprovam o texto.

Paula Miranda, da Uerj, contextualiza que o plano diretor está previsto no Estatuto da Cidade (Lei nº 10.257/2001), lei que regulamenta os artigos 182 e 183 da Constituição Federal, estabelecendo diretrizes gerais da política urbana. “O Estatuto da Cidade obriga todos os municípios com mais de 20 mil habitantes a criar o plano diretor, que deve ser renovado a cada dez anos”, esclarece.

A diretora da Habitat Brasil, Socorro Leite, defende que o documento tenha regras específicas “para regularizar a situação dessas regiões e garantir espaços para a construção de moradias, localizadas em áreas bem estruturadas e com infraestrutura adequada”.

Socorro Leite ressalta que centros urbanos precisam receber atenção especial do plano diretor, “aplicando instrumentos que assegurem a função social da propriedade, como a destinação de imóveis abandonados para a produção de novas moradias”.

Especulação imobiliária

Mais uma função dos planos diretores, acrescenta a ativista, é o combate à especulação imobiliária, ou seja, a prática de comprar imóveis e terrenos com a expectativa principal de revendê-los com lucro, sem uso social. “O município não pode ficar à mercê dos interesses privados”, enfatiza.

Na visão dela, planos diretores não podem apenas favorecer o mercado imobiliário. “O plano tem o poder de estabelecer regras que podem tornar uma área mais ou menos atraente para o mercado imobiliário, interferindo nessa dinâmica e reservando espaços para habitação de interesse social.”

A urbanista Paula Miranda cita como uma dessas regras a possibilidade de Imposto sobre a Propriedade Predial e Territorial Urbano (IPTU) progressivo (com aumento gradativo).

O terreno precisa cumprir uma função social, então, caso o município tenha previsto este instrumento, o poder público pode notificar o proprietário para apresentar projeto de edificação no terreno ou de ocupação de construção ociosa. Não cumprida a obrigação, pode ser cobrado o IPTU progressivo até o cumprimento”, detalha Paula Miranda.

A professora de arquitetura e urbanismo, no entanto, lamenta que, por vezes, sequer são criadas leis específicas para regulamentação e combate à especulação imobiliária.

Apesar da possibilidade de prever, nos planos diretores, uma série de instrumentos que podem exercer controle, de certa forma, sobre a especulação imobiliária, muitas vezes estes não são aplicados. Por vezes, nem são criadas leis específicas para regulamentação. Em alguns casos, o poder público se omite por falta de interesse em relação ao tema, ou por articulação com setores privados”, avalia Paula.
