Atendendo a um pedido da Defensoria Pública do Estado do Amazonas (DPE-AM), a Justiça Estadual suspendeu a ordem de remoção e desmonte de flutuantes das bacias dos rios Negro e Tarumã-Açu, em Manaus, que estavam agendadas para acontecer ainda nesta semana. A decisão liminar do juiz Glen Hudson Paulain Machado, da Vara Especializada do Meio Ambiente da Comarca de Manaus, publicada nesta quarta-feira (20), mantém apenas as remoções das estruturas abandonadas, trabalho que já vem sendo executado pelo Município.
Conforme a decisão, suspensão é válida até que a Comissão de Conflitos Fundiários do Tribunal de Justiça do Estado do Amazonas (TJAM) se manifeste e promova o diálogo entre as partes envolvidas, conforme previsão da Resolução 510/2023 do Conselho Nacional de Justiça (CNJ) e da Portaria 4847/2023 do TJAM, que estabelecem protocolos para o tratamento das ações que envolvam despejos ou reintegrações de posse em imóveis de moradia coletiva ou de área produtiva de populações vulneráveis.
O magistrado acatou a solicitação da Defensoria para atuar no processo na condição de custos vulnerabilis. A DPE-AM foi acionada por pessoas em condição de vulnerabilidade que moram e trabalham em flutuantes e que, com a decisão pela retirada, ficaram sob risco de “perder suas moradias, seu sustento e a totalidade do patrimônio construído ao longo de anos”.
A decisão ressalta que, em ações como a desocupação dos flutuantes do Tarumã – inclusive aqueles que servem de moradias das populações ribeirinha e indígenas –, é preciso levar em conta a nova normativa do CNJ e dos respectivos tribunais, independentemente da fase de tramitação do processo. “Não há nos autos, até o presente momento, qualquer informação acerca de consulta já realizada à referida Comissão [de Conflitos Fundiários do TJAM”, observa o juiz.
A liminar ressalta que, segundo o Instituto de Proteção Ambiental do Amazonas (Ipaam), todos os flutuantes localizados na margem esquerda do rio Negro estão licenciados. O juiz destaca que um laudo técnico, contendo dados sobre o índice de qualidade da água do Tarumã-Açu, não deixa dúvidas acerca do baixo impacto de poluição atualmente na bacia.
De acordo com a Associação de Moradores da Marina do Davi, só naquela comunidade, mais de 250 famílias residentes, divididas em 194 flutuantes, seriam afetadas com a retirada. Segundo a associação, aproximadamente três mil pessoas podem ser impactadas com a ação de retirada dos flutuantes dos rios Negro e Tarumã-Açu.
O processo trata-se de Ação Civil Pública (ACP) ajuizada em 2001 pelo Ministério Público do Estado do Amazonas (MP-AM) contra, à época, o Município de Manaus e 74 proprietários de flutuantes situados às margens dos rios da capital. A ação fundamentava-se em preocupação com o estágio de degradação dos mananciais que circundam o município, e com os prejuízos ambientais atribuídos à proliferação dos flutuantes na região.
